Mass Torts and Class Action Lawsuits 101

Have you experienced, or are you still dealing with, physical or emotional injury that was caused by a company or corporation, perhaps a pharmaceutical brand? For example, you might be suffering from a long-term illness caused by medication or a toxic beauty product, or perhaps you experienced unfair financial loss due to a company’s illegal business practices.

If this sounds like you, you may have the right to take legal action. Joining a class action lawsuit or pursuing mass tort litigation may help you win a settlement of thousands, if not millions, of dollars.

What Is a Class Action Lawsuit?

A class action lawsuit is a legal action undertaken by one or more plaintiffs on their own behalf and on the behalf of everyone else harmed from identical wrongdoing by the same defendant

A plaintiff is the person who initiates the case against the other person or corporation. A plaintiff is also commonly referred to as the victim of the lawsuit.

The individual or company being taken to court for harmful practices is known as the defendant.

In a class action lawsuit, an individual or small group of plaintiffs, in this case known as class representatives or lead plaintiffs, brings a single case against the same defendant or in some lawsuits, multiple defendants.

A lead plaintiff or class representative might be the first person to search for a lawyer to initiate a class action lawsuit. However, in many cases, a lawyer will search for a possible lead plaintiff that they deem as being more representative of the victims as a whole.

In top class action lawsuits there may be only one or two class representatives but there could be thousands of other victims who have been affected by the wrongdoing of the defendant. These people are known as class members. Even though these class members do not take an active role in the legal proceedings initiated by the lead plaintiffs, they are still entitled to part of the class action settlement if the plaintiffs win the case.

If you have been harmed by the wrongdoing of a corporation you may be awarded money by joining a class action lawsuit. You could also decide to become a part of a mass tort lawsuit instead.
